Approved Motion: That the Board of Education of School District No. 61 (Greater Victoria) (the “Board”) read “The Board of Education of School District No. 61 (Greater Victoria) Caledonia Truck Turnaround Disposal (Right-of-Way) of Real Property Bylaw 26-01” in accordance with Sections 68(3) of the School Act (British Columbia). “The Board of Education of School District No. 61 (Greater Victoria) Caledonia Truck Turnaround Right-of-Way Bylaw 26-01” (the “Bylaw”) approves a statutory right-of-way and Section 219 covenant in favour of the City of Victoria (the “City”) to permit the City and members of the general public to use a portion of the lands located at 1211 Gladstone Avenue, Victoria, British Columbia (the “Property”) as shown outlined in bold on Plan EPP148835 for the purposes of a turnaround area for trucks and oversized vehicles attending upon the Property. This statutory right-of-way and Section 219 covenant will replace an existing statutory right-of-way and Section 219 covenant registered against title to the Property in the Land Title Office under registration numbers CA9436385 and CA9436386, respectively, in favour of the City for the same purpose, with the only difference being that the new right-of-way area is a reduced portion of the existing right-of-way area shown in plan EPP103338. The Bylaw authorizes the Secretary-Treasurer to execute the statutory right-of-way and covenant on behalf of the Board. This statutory right-of-way and Section 219 covenant will replace an existing statutory right-of-way and Section 219 covenant registered against title to the Property in the Land Title Office under registration numbers CA9436385 and CA9436386, respectively, in favour of the City for the same purpose, with the only difference being that the new right-of-way area is a reduced portion of the existing right-of-way area shown in plan EPP103338. The Bylaw authorizes the Secretary-Treasurer to execute the statutory right-of-way and covenant on behalf of the Board. WHEREAS in accordance with Section 142 of the School Act, the Board of Education of School District No. 61 (Greater Victoria) (hereinafter called the “Board”) has submitted a capital plan to the Minister of Education (hereinafter called the "Minister") and the Minister has approved the capital plan or has approved a capital plan with modifications, NOW THEREFORE in accordance with Section 143 of the School Act, the Board has prepared this Capital Bylaw and agrees to do the following: (a) Authorize the Secretary-Treasurer to execute a capital project funding agreement(s) related to the capital project(s) contemplated by the capital plan or the capital plan with modifications; (b) Upon ministerial approval to proceed, commence the capital project(s) and proceed diligently and use its best efforts to complete each capital project substantially as directed by the Minister; (c) Observe and comply with any order, regulation, or policy of the Minister as may be applicable to the Board or the capital project(s); and, (d) Maintain proper books of account, and other information and documents with respect to the affairs of the capital project(s), as may be prescribed by the Minister. NOW THEREFORE be it enacted as a Bylaw of the Board that the Sale Agreement and the Subdivision and Sale be and are hereby authorized, ratified and approved, subject to the Minister of Education providing a written Certificate of Disposal approving the sale of the Lands. BE IT FURTHER enacted that the Secretary-Treasurer be and is hereby authorized on behalf of the Board to execute and deliver the Sale Agreement and, subject to the Minister’s Approval, all documents required to complete the Subdivision and Sale, and all related and ancillary documents, with all such amendments thereto as the Secretary-Treasurer may, in her discretion, consider advisable. This Bylaw may be cited as “School District No. 61 (Greater Victoria) Lansdowne Middle School, South Campus (formerly Richmond Elementary School) Site Partial Disposal Bylaw 2022”. Read a first time this 24th day of January, 2022. Read a second time this 24th day of January, 2022. Read a third this 14th day of March, 2022., and finally passed and adopted this 14th day of March, 2022.
Action: The Bylaw was given the 3rd and final reading by the Board.

Approved Motion: That the Board of Education of School District No. 61 (Greater Victoria) assign Trustee Ferris to attend a meeting at the Township of Esquimalt, along with a staff member, in order to hear their feedback with respect to childcare in District school facilities; AND FURTHER That Chair Painter respond to the January 28, 2022 letter advising that Trustee Ferris would be assigned to attend.
Action: The Board voted in favour of assigning Trustee Ferris to this meeting invitation as the liaison to the Township of Esquimalt, and the Chair will send a letter to the Township of Esquimalt advising them.
